A Donegal solicitor has accused the State of ‘dragging their heels’ in the case of a man charged with slashing his wife with a broken glass in Convoy.
Monday’s sitting of Letterkenny District Court heard that directions are still awaited from the Director of Public Prosecutions (DPP) in the case of Carl Hargaden.
Hargaden is alleged to have slashed Anna Hargaden’s cheek, wrist and neck with a broken glass during an incident at Flax Fields, Convoy on Sunday, January 28.
Hargaden, a 61-year-old of Flax Fields, Convoy is in custody at Castlerea prison having had bail revoked at a previous sitting of the court.
He appeared by video link at Letterkenny District Court, which heard that directions were not yet available.
“It is a bit ridiculous that the state can’t provide directions,” Mr Gallagher blasted. “Even from a jurisdictional point of view, matters could be progressed.
“He is entitled to some fair play here. I am getting concerned that the State is dragging their heels again with a Donegal case.”
Sergeant Jim Collins told the court that he was seeking a further two weeks to allow directions to be finalised.
Mr Gallagher said this was the fourth remand and suggested that the matter could be marked peremptory against the State on the next occasion.
Judge Éiteáin Cunningham said that application could be renewed at the next date and put the matter back to March 4, 2024 for directions.
Hargaden was charged with assaulting Anna Hargaden causing her harm, contrary to Section 3 of the Non-Fatal Offences Against the Person Act, 1997. Photographs of the injuries were submitted to the court.
Gardai told the court that Hargaden cut the back of the woman’s head with the same implement. The woman also sustained injuries to her neck and jaw in the incident.
He was also charged with breaking the woman’s glasses and with taking her mobile phone.
During the incident, Hargaden claimed to have placed the woman’s mobile phone in a fridge, but the phone was located outside the premises on Monday.
The injured woman was said to have attended for plastic surgery in Galway.
